Use of the Trademark and AI-Generated Content

WAKEPARADISE® is a registered trademark.

The WAKEPARADISE® name, its logos, graphic elements, distinctive signs, official images and any other elements associated with the brand’s identity constitute distinctive assets of Wakeparadise and are protected under applicable intellectual and industrial property laws.

Wakeparadise encourages the spontaneous sharing of experiences at its facilities and the publication of photographs and videos created by its customers, athletes and visitors, provided that such content respects the individuals depicted and complies with applicable laws and regulations.

Content Generated or Modified Using Artificial Intelligence

The use of Artificial Intelligence tools to create, modify or manipulate images, videos, audio or other content relating to Wakeparadise must respect the WAKEPARADISE® trademark and brand identity.

In particular, without Wakeparadise’s prior written authorisation, the WAKEPARADISE® trademark, logo or other distinctive elements may not be used in content generated or significantly modified using Artificial Intelligence where such use could:

  • make the content appear to have been produced, commissioned, approved or sponsored by Wakeparadise;

  • suggest a collaboration, partnership or affiliation that does not exist;

  • attribute to Wakeparadise messages, conduct, initiatives or positions that do not originate from the brand;

  • alter or use the logo or other distinctive elements in a misleading manner or in a way that is likely to cause confusion;

  • associate the trademark with offensive, discriminatory, sexually explicit, violent or illegal content, or with any content that may otherwise harm the reputation of the brand;

  • use the Wakeparadise identity to promote third-party products, services, events or commercial activities without authorisation;

  • artificially reproduce environments, staff members, athletes or situations associated with Wakeparadise and present them, whether expressly or implicitly, as real or official when they are not.

Social Media, Tags and Mentions

Customers and visitors are naturally permitted to mention or tag Wakeparadise’s official accounts.

However, tags, the WAKEPARADISE® name, logo or other identifying elements must not be used in a manner that could lead the public to believe that artificially generated or manipulated content was created, authorised or approved by Wakeparadise.

Any reposting or sharing of content by Wakeparadise’s official accounts does not automatically constitute authorisation for the commercial use of the trademark or any related distinctive elements.

Commercial Use of the Trademark

Any use by third parties of the WAKEPARADISE® name, logo or brand identity for advertising, promotional or commercial purposes requires Wakeparadise’s prior written authorisation.

This includes, by way of example, collaborations with creators and influencers, advertising campaigns, merchandising, events, sponsorships, promotional content and productions created using Artificial Intelligence tools.

Brand Protection

Wakeparadise reserves the right to request the modification or removal of content that improperly uses its trademark or other protected elements and, where necessary, to report such content to the relevant platforms using the available intellectual property protection procedures.

In the event of serious or repeated infringements, Wakeparadise also reserves the right to take any action necessary to protect its trademark, image and brand reputation before the competent authorities and through any other appropriate legal channels.

Requests for Authorisation

Creators, companies, agencies, photographers, videomakers and other parties wishing to use the WAKEPARADISE® trademark or create commercial or Artificial Intelligence-generated content associated with the brand may request prior authorisation from Wakeparadise through the official contact details provided on the website.

Use of Content

You may use the website content solely for personal and non-commercial purposes. You may not copy, modify, distribute, or otherwise exploit any content from this website without our prior written authorization. The use of the website content is entirely at your own risk, and we accept no responsibility for any consequences arising from its use.

Blog and users Comments

Our website may include a blog containing information and articles related to sports activities. User comments are welcome; however, we reserve the right to moderate, edit, or remove comments that are deemed inappropriate, offensive, or in violation of these Terms and Conditions.

We reserve the right to modify or update these Terms and Conditions at any time without prior notice. Users are encouraged to review this page periodically. Continued use of the website following the publication of any changes constitutes acceptance of those changes.

membership, SPORTS SERVICES, BOOKINGS AND ACTIVITIES

Wakeparadise Credit

Unless otherwise specified, all refunds provided under these Terms and Conditions are issued exclusively as Wakeparadise account credit. Such credit cannot be redeemed for cash and may be used to purchase activities and services offered by the club.

Gift Cards

Gift Cards are valid for one year from the date of purchase. Upon redemption, the purchased amount will be converted into credit directly on the Wakeparadise account of the person using the Gift Card. Once redeemed, the credit has no expiration date and may be used freely.

Gift Cards are non-refundable and cannot be exchanged, redeemed, or converted into cash, either in whole or in part. If unused, Gift Cards may be transferred to another person within their remaining validity period. Any transfer does not extend the Gift Card expiration date.

Once the validity period has expired, the Gift Card may no longer be used and no refund will be granted.

Membership

A valid membership is required to access the club and is non-refundable. Membership is valid until 31 December and can be renewed in accordance with applicable regulations and sports federation requirements.

Members agree to comply with the club’s statutes, internal regulations, safety procedures, and instructions provided by Wakeparadise staff.

Operational decisions made by staff for safety reasons, facility management, weather conditions, participant skill level, or the protection of other users are binding and must be respected.

In the event of conduct contrary to club regulations, safety rules, staff instructions, or behavior that may damage the facility, equipment, staff, other users, or the reputation of the organization, Management reserves the right to suspend or revoke

membership and access to the facility.

Suspension or revocation of membership shall not entitle the member to any refund of membership fees, subscriptions, packages, Gift Cards, or any other purchased services.

Bookings and No-Show Policy

Bookings are considered confirmed once the purchase or reservation process has been completed through Wakeparadise’s official channels.

In the event of a no-show without prior notice in accordance with these Terms and Conditions, the activity will be considered fully used and no refund or credit will be issued.

Customer delays do not entitle the customer to an extension of the booked activity or any refund for unused time.

Wakeparadise reserves the right to reassign reserved spots if a customer fails to arrive within a reasonable period after the scheduled start time and has not communicated any delay.

Cancellation Policy

Refunds for Surf Pool, System 2.0, SUP and Skate Activities

Cancellations communicated by the evening of the day prior to the booked activity are eligible for a full refund credited to the user’s Wakeparadise account.

Cancellations requested within four hours of the scheduled activity are eligible for a 50% refund.

No refund is available for cancellations made less than four hours before the activity.

No refund or credit will be granted in case of a no-show.

For Surf Pool activities, refunds may not be granted if the cancellation prevents the minimum number of participants required to operate the session from being reached.

Refunds for Full Size Activities

Full Size activities may be refunded upon timely communication to the club administration.

If the customer has already checked in or entered the facility and requests a refund during weekends or public holidays, an amount of €20.00 will be retained as a minimum facility access and service fee.

Any remaining unused amount will be calculated on a pro-rata basis and credited exclusively to the Wakeparadise account used for the purchase.

Accompanying Guests

All individuals entering the club must be properly registered and hold a valid membership.

During weekdays, accompanying guests with a valid membership may access the facility freely.

During weekends and public holidays, accompanying guests are required to purchase one of the activities offered by the club.

Exceptions:

  • One accompanying guardian with a valid membership is permitted for each minor participant.
  • One accompanying minor with a valid membership is permitted for each adult participant.

Cancellation Policy in Case of Adverse Events

Facility Malfunctions

If an activity cannot be carried out due to technical issues affecting the facility or equipment, a refund proportional to the unused portion of the activity will be credited to the user’s Wakeparadise account.

Adverse Weather Conditions

The assessment of whether weather conditions are suitable for activities is exclusively at the discretion of Wakeparadise Management and staff.

If activities are interrupted due to weather conditions that prevent safe operation or proper functioning of the facilities, a proportional refund for the unused portion of the activity will be credited to the user’s Wakeparadise account.

If the facility remains open and activities are operating normally, no refund will be granted for cancellations based on weather conditions subjectively considered unsuitable by the customer.

Packages

Packages are valid for one year from the date of purchase unless otherwise specified at the time of purchase. Package validity cannot be extended.

Before the expiration date, the holder may request reimbursement of the unused portion of the package. The refund will be calculated on a pro-rata basis according to the value of unused activities and issued exclusively as Wakeparadise account credit.

No cash refunds will be provided.

Upon expiration, any unused services included in the package shall be forfeited and no refund or compensation shall be due.

Membership Plans

Membership plans and subscriptions are non-refundable and cannot be extended.

In the event of an injury preventing participation in sports activities, a temporary suspension may be requested upon submission of valid medical documentation.

During the suspension period, the subscription will be frozen and its validity extended by a number of days equal to the approved suspension period.

At the end of the suspension period, the subscription will automatically resume with the remaining days still available.

Except as expressly provided above, subscriptions may not be suspended, extended, or refunded.

Products and Merchandise

Wakeparadise may offer merchandise, apparel, sporting goods, and other products for purchase through its online store.

Product features and prices are described in the relevant product pages available on the website.

Orders are subject to stock availability. In the event that a purchased product becomes unavailable, Wakeparadise will promptly notify the customer and provide either a refund or equivalent credit.

Returns, replacements, and consumer rights shall be managed in accordance with applicable Italian consumer protection laws.
